China Everbright Bank (Europe) S.A. is a public limited liability company (société anonyme) incorporated under the laws of the Grand Duchy of Luxembourg, having its registered office at 52 Boulevard Prince Henri, L-1724 Luxembourg, and registered with the Luxembourg Trade and Companies Register (Registre de Commerce et des Sociétés — RCS) under number B213668.

The company is authorised as a credit institution pursuant to the Luxembourg Law of 5 April 1993 on the financial sector, as amended, and is subject to prudential supervision by the Commission de Surveillance du Secteur Financier (CSSF), 283 route d’Arlon, L-1150 Luxembourg, and, in respect of monetary policy operations and significant-institution oversight arrangements, to the framework of the Single Supervisory Mechanism.

This website is published and operated by China Everbright Bank (Europe) S.A.. Responsibility for its content rests with the company’s Corporate Communications function, acting under the oversight of the Authorised Management.

2. Deposit Guarantee & Investor Compensation

China Everbright Bank (Europe) S.A. is an affiliated member of the Fonds de Garantie des Dépôts Luxembourg (FGDL) and of the Système d’Indemnisation des Investisseurs Luxembourg (SIIL).

• Eligible cash deposits are protected up to EUR 100,000 (or the equivalent in another currency) per depositor per credit institution, in accordance with Directive 2014/49/EU as transposed into Luxembourg law.
• Certain temporary high balances may benefit from a higher level of cover for a limited period, subject to the conditions set out in the applicable legislation.
• Eligible claims relating to investment business are covered by the SIIL up to EUR 20,000 per investor.
• Not all categories of depositor or deposit are eligible. Exclusions include, among others, deposits of credit institutions and of financial institutions on their own behalf, own funds instruments, and deposits arising from transactions in connection with which a criminal conviction for money laundering has been obtained.
• A depositor information sheet is provided at account opening and annually thereafter. Full details of protection criteria and exclusion categories are published by the scheme at www.fgdl.lu.

3. Data Protection Notice (EU GDPR)

In accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, “GDPR”) and the Luxembourg Act of 1 August 2018 on the organisation of the National Commission for Data Protection (CNPD), China Everbright Bank (Europe) S.A. acts as data controller in respect of personal data processed in the course of client onboarding, corporate communication, transaction execution and the operation of this website.

Personal data may be disclosed to the parent undertaking and to entities within the group where necessary for group risk management and consolidated reporting, to service providers acting as processors under written contract, to correspondent banks, market infrastructures and settlement systems where necessary to execute an instruction, and to competent authorities, tax authorities and courts where required by law. Where personal data is transferred outside the European Economic Area, that transfer is made on the basis of an adequacy decision or of standard contractual clauses adopted by the European Commission, supplemented where required by additional technical and organisational measures.

3.3 Retention

Personal data is retained for the period necessary to fulfil the purpose for which it was collected and thereafter for the retention periods prescribed by Luxembourg banking, anti-money-laundering, accounting and commercial law — generally ten years from the end of the business relationship or from the execution of the relevant transaction — and for such further period as may be required to defend a legal claim.

• Right to erasure, where the conditions of Article 17 GDPR are met and no overriding legal retention obligation applies.
• Right to restriction of processing and right to object to processing based on legitimate interests.
• Right to data portability in respect of data provided by the data subject and processed by automated means on the basis of consent or of a contract.
• Right to withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
• Right to lodge a complaint with the CNPD, 15 Boulevard du Jazz, L-4370 Belvaux, Grand Duchy of Luxembourg.

We will respond within one month of receipt, and will inform you if that period must be extended.

3.5 Automated decision-making

We do not take decisions producing legal effects concerning a data subject, or similarly significantly affecting them, based solely on automated processing. Screening and monitoring tools used for financial-crime prevention generate alerts which are reviewed by qualified staff before any action is taken.

4. Cookies & Similar Technologies

This website is deliberately built as a set of static pages and uses the minimum technology necessary to deliver them. We do not operate advertising networks, cross-site tracking pixels or third-party profiling tags on this site.

Your browser allows you to block or delete cookies and site data through its settings. Blocking strictly necessary storage may prevent parts of the site from functioning. Where a page embeds a resource served by a third party, that third party may receive your IP address and the address of the page you are viewing; we limit such embedding to what is required to render the page.

12.1 How to protect yourself

• Check that any domain purporting to belong to the entity is the one published on this website, character by character. Look-alike domains frequently substitute or add a single character.

We aim to resolve complaints promptly, fairly and at the first point of contact. Our complaints procedure follows CSSF Regulation N° 16-07 relating to the out-of-court resolution of complaints.

Referral to the CSSF is free of charge and does not prejudice your right to bring legal proceedings. Complaints concerning the processing of personal data may also be addressed to the CNPD, as described in section 3.
